These Terms and Conditions govern the use of Driftholm's website and the services we provide. By contacting us, engaging our services, or using our website, you agree to the terms below. Please read them carefully.

1. Definitions

  • "Driftholm", "we", "us", "our" refers to the property rental service operating from 159 Thalang Road, Phuket 83000, Thailand.
  • "Client", "you", "your" refers to any individual who contacts us, engages our services, or uses our website.
  • "Services" refers to our Seasonal Retreat Rentals, Comprehensive Rental Search, and Remote Tenant Support offerings.
  • "Agreement" refers to the arrangement formed when you engage our services, whether formally or informally.
  • "Property" refers to any residential real estate that is the subject of our service engagement.

2. Acceptance of Terms

By using our website or engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a service agreement, and accept these Terms and Conditions in full.

If you are acting on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these terms.

3. Description of Services

Driftholm provides three core services:

  • Seasonal Retreat Rentals: Sourcing and presenting furnished properties for short-to-medium stays of two weeks to four months. Pricing is ฿12,000 per week as a base, with variations depending on property type and duration.
  • Comprehensive Rental Search: A structured process to identify and present suitable annual lease properties, including accompanied viewings and lease review. Fee is ฿25,000 (one-time), invoiced upon lease signing.
  • Remote Tenant Support: A monthly on-ground management service for existing tenants. Fee is ฿5,500 per month, billed at the start of each month.

Service details may be updated from time to time. We will communicate material changes to active clients in advance.

4. Our Role and Limitations

Driftholm acts as a tenant-facing service provider. We are not a landlord, property owner, or party to any lease agreement between you and a property owner. Lease agreements are directly between you and the respective landlord.

Our role in the rental search process is advisory and facilitative. While we conduct physical property assessments and provide honest condition notes, we cannot guarantee the ongoing condition of any property or the future conduct of any landlord.

Lease guidance provided is for informational purposes and does not constitute legal advice. We recommend consulting a qualified Thai property lawyer for any complex contractual matters.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information when using our services
  • Engage with us in good faith throughout the search or support process
  • Honour any viewing appointments or give reasonable advance notice of cancellation
  • Not approach landlords introduced through Driftholm for independent arrangements during or within three months of our engagement, without our written agreement
  • Pay any agreed fees on time and in the agreed currency (Thai Baht)

6. Payment Terms

Fees are as stated in Section 3. Invoices are issued in Thai Baht. Payment methods will be agreed in advance of service commencement. The Comprehensive Rental Search fee is due within five business days of a lease being signed. Monthly support fees are billed at the beginning of each month.

We do not offer partial refunds on completed work. If you withdraw from a search after we have invested significant time and resources, we may request a partial fee reflecting work done to that point. This will be discussed openly and not imposed unilaterally.

7. Intellectual Property

All content on the Driftholm website — including text, design, and structure — is our intellectual property and may not be reproduced, copied, or used commercially without written permission.

Property notes, shortlists, and reports prepared for clients are provided for personal use in the context of the service engagement only.

8. Disclaimers

Our services are provided with reasonable professional care, but we cannot guarantee specific outcomes. We make no representations about the availability of any particular property, future rental prices, or the outcome of any lease negotiation.

Information on our website is provided in good faith and for general guidance only. It is not a substitute for professional legal, financial, or real estate advice.

9. Limitation of Liability

To the extent permitted by Thai law, Driftholm's liability to you in connection with any service or claim is limited to the fees paid for the relevant service engagement.

We are not liable for: loss of income, indirect or consequential losses, property damage caused by third parties, or any matter outside our reasonable control.

10. Termination

Either party may end a service engagement with reasonable written notice. For monthly support services, one month's notice is required. If we cease operations or are unable to continue service delivery, we will inform you promptly and, where applicable, arrange a pro-rated refund.

We may terminate an engagement immediately if a client provides materially false information, engages in conduct harmful to our team, or breaches these terms in a significant way.

11. Governing Law and Disputes

These terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from our services will be addressed through good-faith discussion in the first instance. If that does not resolve the matter, disputes will be referred to the courts of Phuket Province, Thailand.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on our website. For active service engagements, material changes will be communicated by email. Continued use of our services after notification constitutes acceptance.
